By downloading, installing, or using the CoherenceIQ mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legal agreement between you and Deep Dive Consulting LLC ("Company," "we," "us," or "our").
CoherenceIQ is a wellness and biofeedback application that integrates with compatible EEG and heart rate monitoring devices to provide real-time coherence measurements, session tracking, AI-powered analysis, and progress reporting during meditation practice.
IMPORTANT: CoherenceIQ is a wellness and self-awareness tool. It is NOT a medical device and does NOT diagnose, treat, cure, or prevent any medical condition, disease, or health problem. The measurements and scores provided are for informational and self-improvement purposes only. Always consult a qualified healthcare provider for medical concerns. Do not use this App as a substitute for professional medical advice, diagnosis, or treatment.
You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.
You may register for an account using Sign In with Apple. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Free Tier: The App offers a free tier with limited features, including access to the meditation library and basic playback.
Premium Subscription: Full access to all features, including real-time coherence scoring, AI session analysis, and progress tracking, requires a paid subscription.
Subscription Plans:
Free Trial: New subscribers may be eligible for a free trial period. Trial eligibility is determined at Apple's discretion and may not be available to users who have previously subscribed.
Billing: Payment is charged to your Apple ID at purchase confirmation. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period. You can manage and cancel your subscription at any time through your Apple ID account settings.
Refunds: Refund requests are handled by Apple in accordance with their refund policies. We do not control or process refunds directly.
Price Changes: We reserve the right to modify subscription prices with reasonable advance notice.
Full functionality of CoherenceIQ requires compatible third-party hardware including an EEG headband (such as the Muse S Gen 2) and a heart rate monitor (such as the Polar H10). These devices are sold separately and are subject to their own terms and warranties. We are not responsible for the performance, availability, or compatibility of third-party hardware.
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
The App, including its content, features, design, code, and all intellectual property rights therein, is owned by Deep Dive Consulting LLC and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial use.
Meditation content available through the App may be owned by third parties and is subject to separate licensing terms.
Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection, use, and storage of your data as described in our Privacy Policy.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEEP DIVE CONSULTING LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Deep Dive Consulting LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the App or violation of these Terms.
We reserve the right to suspend or terminate your account and access to the App at our discretion, with or without cause, and with or without notice. You may terminate your account at any time through the Settings menu in the App.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Massachusetts.
We reserve the right to modify these Terms at any time. We will provide notice of material changes through the App or via email. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
